TACOMA – Tacoma Goodwill and the Department of Labor & Industries (L&I) have settled an appeal allowing both agencies to continue working together on safety for people with disabilities.

“We appreciate the opportunity to join with L&I in supporting workers’ safety, especially for employees with developmental disabilities,” said Terry A. Hayes, Tacoma Goodwill CEO. “We are serious about our commitment to exceed the spirit and intent of state safety standards.”

The settlement modifies L&I’s initial position and now lists three citations that involve the implementation of Goodwill’s Accident Prevention Program, general record keeping procedures and safety improvements surrounding a box-moving machine, also called a “tipper.” Goodwill will be fined $13,300.

The citations were modified from the initial findings in the April 15, 2008, death of Nick Miller. Miller, 27, had been employed in Goodwill’s Supported Employment program for people with developmental disabilities.

“We fully support Goodwill’s mission of providing opportunities to people with developmental disabilities,” said Steve Cant, assistant director for L&I’s Division of Occupational Safety and Health. “We’ve accomplished our goal of a safer workplace with this settlement, and we look forward to continued work with Goodwill to ensure best safety practices for the future.”

Hayes said the loss of Nick Miller is still deeply felt by the entire agency and Goodwill will continue to advocate for people with disabilities. “We remain committed to hiring people with disabilities because everyone deserves the opportunity for a full life through work,” Hayes said.
